1. Introduction and Acceptance

Welcome to SME Hub ("Platform", "we", "us", "our"), an online marketplace operated by Etihad Go Telecommunication Company, a company duly established and operating under the laws of the Kingdom of Saudi Arabia.

The Platform is accessible at sme.go.sa. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Etihad Go Telecommunication Company governing your access to and use of the Platform, including registration, browsing, purchasing products and services, making payments, and all related activities.

2. Eligibility and Registration

To register on the Platform, you must:

• Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher;
• Have full legal capacity to enter into binding contracts under the laws of the Kingdom of Saudi Arabia;
• Not be prohibited from using the Platform under any applicable law or regulation;
• Provide accurate, complete, and current information during registration.

By registering, you represent and warrant that all information you provide is truthful, accurate, and up to date, and that you will maintain the accuracy of such information throughout your use of the Platform. We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion.

3. Account Security and Responsibility

You are solely responsible for:

• Maintaining the confidentiality of your account credentials (username and password);
• All activities that occur under your account, whether or not authorized by you;
• Notifying us immediately at info@go.com.sa upon becoming aware of any unauthorized access or security breach.

You agree not to share, transfer, or sell access to your account. We shall not be liable for any loss or damage arising from your failure to maintain account security.

4. Platform Services

SME Hub is a marketplace that connects buyer with vendor offering Etihad Go Telecommunication Company products and services. As a registered buyer, you may:

• Browse listings of products and services offered by vendor;
• Place orders and make payments through the Platform's integrated payment gateway;
• Access order history, invoices, and account activity;
• Subscribe to paid plans or service tiers offered by the Platform.

We act as seller of any products or services listed on the Platform. The contractual relationship for the supply of goods and services is between you and Etihad Go Telecommunication Company.

5. Subscription, Fees, and Payments

5.1 Subscription Fees: Access to certain features of the Platform may require a paid subscription. All applicable fees will be clearly disclosed before you commit to a subscription plan. Fees are stated in Saudi Riyals (SAR) and are inclusive of applicable Value Added Tax (VAT) at the rate prescribed by the Zakat, Tax and Customs Authority (ZATCA).

5.2 Payment Processing: Payments are processed directly through the Platform using secure, PCI-DSS compliant payment infrastructure. By submitting a payment, you authorize us to charge your selected payment method for the applicable amount.

5.3 Billing and Renewal: Subscription plans are billed on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew at the end of each billing period unless you cancel at least 48 hours before the renewal date through your account settings.

5.4 Refunds: All subscription fees are non-refundable except where required by applicable Saudi consumer protection laws or as expressly stated in our Refund Policy.

5.5 Failed Payments: If a payment fails, we reserve the right to suspend access to paid features until payment is successfully processed. We may retry failed payments and will notify you via your registered email address.

6. Prohibited Conduct

You agree not to use the Platform to:

• Violate any applicable local, national, or international law or regulation, including the laws of the Kingdom of Saudi Arabia;
• Infringe the intellectual property rights of any third party;
• Submit false, misleading, or fraudulent information;
• Engage in unauthorized data scraping, harvesting, or automated access;
• Introduce malware, viruses, or any harmful code;
• Circumvent security measures or access restricted areas of the Platform;
• Engage in any activity that disrupts the Platform's operations or harms other users;
• Use the Platform for any purpose that is contrary to public order or morals as defined under Saudi law.

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and underlying code ("Platform Content"), is the exclusive property of Etihad Go Telecommunication Company or its licensors and is protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial purchasing activities. You may not reproduce, distribute, modify, or create derivative works from any Platform Content without prior written consent.

8. Privacy and Data Protection

8.1 Data Collection: We collect personal data you provide during registration and use of the Platform, including name, contact information, payment details, and usage data. This data is processed in accordance with our Privacy Policy.

8.2 Compliance with Saudi PDPL: We are committed to compliance with the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia and its implementing regulations. Your personal data will be processed only for the purposes for which it was collected, retained for no longer than necessary, and protected by appropriate technical and organizational measures.

8.3 Data Sharing: We may share your data with vendor to fulfil your orders, with payment processors to facilitate transactions, and with regulatory authorities as required by law. We will not sell your personal data to third parties.

9. Disclaimers and Limitation of Liability

We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

10. Indemnification

You agree to indemnify, defend, and hold harmless Etihad Go Telecommunication Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; or (c) your infringement of any third-party rights.

11. Termination and Suspension

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for reasons including but not limited to: Breach of these Terms; Suspected fraudulent, abusive, or unlawful activity; Non-payment of applicable fees. You may terminate your account at any time by contacting info@go.com.sa. Termination does not affect any obligations or liabilities accrued prior to termination.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia. 13. Amendments to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and/or sending an email to your registered address. Your continued use of the Platform following notice of changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform.
